1. Who we are

This website, maltechafricahub.co.za, is operated by Maltech Africa Business Consultancy & Advisory Services (Reg. No. 2022/541785/07), trading as Maltech-Africa, a registered Trust and Company Service Provider (TCSP ID 65232), at 156A Geldenhuys Street, Patryshoek AH, Pretoria, 0182. We are the "responsible party" under the Protection of Personal Information Act 4 of 2013 (POPIA).

2. What personal information we collect

Depending on the service you ask for, we may collect:

• Contact details: name, email address, phone number, and the service you are enquiring about.

• Identity and address documents: certified copies of your ID or passport and proof of address.

• Company information: company names, registration details, director and shareholder information, beneficial ownership details, and tax and compliance records.

• Service-specific documents: for example, employment, qualification or permit documents for work permit and visa applications.

• Payment information: details needed to invoice you and confirm payment. We do not store full card details. Card payments are processed by our payment provider.

• Website usage data: technical data such as your IP address, browser, device and pages visited, collected through cookies and analytics tools.

3. Why we collect it

We process personal information to:

• respond to your enquiries and book consultations;

• register, maintain and bring companies into compliance with CIPC, SARS and other regulators;

• prepare and submit applications on your behalf (for example CIPC, SARS, DHA, the Department of Employment and Labour, DTIC and CSD);

• verify identity and beneficial ownership as required of us as a TCSP, including under the Financial Intelligence Centre Act 38 of 2001 (FICA);

• invoice you and keep financial records;

• improve our website and services; and

• send you service updates and, where you have agreed or the law allows, marketing messages.

We only process your information where you have consented, where it is needed to perform our agreement with you, where the law requires it, or where it is in our legitimate interests or yours, and only to the extent necessary.

4. Who we share it with

We share personal information only as needed to deliver the service you asked for, with:

• government bodies and regulators such as CIPC, SARS, the Department of Home Affairs, the Department of Employment and Labour, DTIC, the Compensation Fund and, for Zimbabwean services, the relevant Zimbabwean registries and authorities;

• banks and payment providers;

• professional partners we engage for your matter (for example accountants, commissioners of oaths and translators); and

• website, email and hosting service providers who process data for us under their own security obligations.

We do not sell your personal information.

5. Transfers outside South Africa

Some services involve Zimbabwe or other countries, and some of our providers store data outside South Africa. Where we transfer personal information across borders, we do so only where the recipient is subject to law or binding rules that provide a similar level of protection, where you consent, or where the transfer is necessary to perform our agreement with you.

6. How long we keep it

We keep personal information only as long as needed for the purpose it was collected, and as long as the law requires. Records we must keep under FICA and tax and companies legislation are retained for the legally required period (at least five years in many cases). After that, we delete or de-identify the information.

7. How we protect it

We use reasonable technical and organisational measures to protect personal information against loss, damage, unauthorised access or disclosure, including access controls, secure storage and confidentiality obligations on our staff and service providers. No online system is completely secure. If a security compromise affects your information, we will notify you and the Information Regulator as POPIA requires.

8. Your rights

Under POPIA you have the right to:

• ask whether we hold your personal information and request access to it;

• request correction or deletion of information that is inaccurate, outdated, incomplete or unlawfully held;

• object to processing on reasonable grounds;

• withdraw your consent at any time (this does not affect processing done before you withdrew it);

• object to direct marketing and opt out at any time; and

• complain to the Information Regulator if you believe your rights have been infringed.

To exercise any of these rights, email info@maltechafrica.co.za and mark it "Privacy request". We may need to verify your identity first. Some records we are legally required to keep cannot be deleted on request.

9. Cookies and analytics

Our website uses cookies and similar technologies to make the site work, remember your preferences and understand how visitors use it. You can accept or decline non-essential cookies through the cookie notice and manage them in your browser settings. Blocking cookies may affect how the site works.

10. Marketing

We will send marketing messages only to people who have agreed to receive them or where the law permits, and every message will include a way to opt out.

11. Children

Our services are for adults and businesses. We do not knowingly collect personal information from anyone under 18 without the consent of a parent or guardian.

12. Links to other websites

Our site links to other websites, including government sites and our network sites. We are not responsible for their privacy practices, so please read their policies.

13. Changes to this policy

We may update this policy from time to time. The "Last updated" date at the top shows the current version.
